Diamond and Gemstone Certification Guarantee

At Al Almas Alfaridah, we are committed to providing diamonds and gemstones accompanied by certificates from recognized gemological laboratories, including GIA, AGS, HRD, IGI, and EGL, as well as the Diamond Factory (DF) and the International Colored Gemstone Laboratory (ICL).

These certificates provide details of the examined diamond or gemstone, including its characteristics and quality. We prioritize transparency and reliability by offering stones certified by recognized laboratories in the industry, rather than relying solely on certificates issued internally by sellers.

The Al Almas Alfaridah Diamond and Gemstone Information Guarantee

At Al Almas Alfaridah, we are committed to providing accurate and comprehensive information about the diamonds and gemstones listed on our website. This includes the available details regarding each stone’s characteristics, as well as its certification information and the issuing laboratory, where applicable.

Al Almas Alfaridah Money-Back Guarantee

Eligible online purchases may be subject to a cancellation and refund request within seven (7) days from the date the product is dispatched through FedEx or made available for collection by the customer at our showroom or another designated collection point, subject to the applicable terms and conditions and Saudi laws and regulations.

This cancellation right does not apply to products made to the customer’s specifications or manufactured upon request, except where the product is defective or does not conform to the agreed specifications, as provided by applicable law.

Products that are defective, counterfeit, or do not conform to the agreed specifications remain subject to the customer’s rights under applicable Saudi laws and regulations.

Return requests must be submitted through our designated customer service channels. Any applicable return procedures and costs shall be handled in accordance with Saudi laws and regulations. Nothing in this policy limits any mandatory consumer rights.

Provided that the product is eligible for return and is returned in its original condition within the applicable return period, Al Almas Alfaridah will process a refund in accordance with its Return and Refund Policy and applicable Saudi laws and regulations. This policy does not limit any mandatory rights available to customers under applicable law.

To request a return or refund, please contact Al Almas Alfaridah’s Customer Service team through our designated customer support channels. Our team will guide you through the return process and explain the applicable requirements and next steps.

Al Almas Alfaridah Lifetime Warranty Against Manufacturing Defects

Al Almas Alfaridah offers a lifetime warranty covering manufacturing defects in its jewellery, subject to the applicable warranty terms and conditions. Certain exclusions and limitations may apply; this warranty does not affect any mandatory rights or remedies available to customers under applicable Saudi laws and regulations.

Al Almas Alfaridah Ring Resizing Guarantee

Al Almas Alfaridah offers complimentary ring resizing for eligible ring purchases, provided that the request is submitted within sixty (60) days from the date of purchase. This service is subject to the ring’s design, material, and suitability for resizing. Custom-made or bespoke rings are excluded from this guarantee unless otherwise agreed in writing.

This guarantee does not affect any mandatory rights available to customers under applicable Saudi laws and regulations.

Al Almas Alfaridah Jewellery Manufacturing Guarantee

At Al Almas Alfaridah, we are committed to maintaining high standards of craftsmanship and quality in our jewellery. We aim to ensure that our products meet applicable quality requirements and comply with relevant Saudi laws and regulations governing precious metals and jewellery.

Where applicable, jewellery markings and identification shall comply with the requirements of the competent Saudi authorities.

Ordering Process and Formation of the Sales Contract

  • Adding Products to Your Cart Customers may select their desired diamonds, gemstones, jewellery, and other available products and add them to their shopping cart.
  • Reviewing Your Order Before completing the purchase, customers can review the order summary, including the selected products, quantities, applicable prices, and any additional charges.
  • Personalisation and Engraving Where available, customers may request personalization or engraving for eligible products before confirming their order. Additional fees may apply, and the applicable charges will be communicated before the order is placed. For bespoke or custom-made products, personalization requirements must be agreed upon during the design and ordering process.
  • Order Confirmation Once an order has been submitted, Al Almas Alfaridah will send an order confirmation to the customer's registered email address or other designated contact channel. Receipt of this confirmation does not, by itself, constitute acceptance of the order or formation of a binding sales contract, unless expressly stated otherwise.
  • Order Review and Product Availability Al Almas Alfaridah will review the order to verify product availability, pricing, and the relevant order details. If a pricing discrepancy, availability issue, or other material issue arises, the customer will be notified and informed of the available options before the order proceeds.
  • Shipping and Collection For delivery orders, Al Almas Alfaridah will arrange shipment and provide the customer with a dispatch or delivery notification, as applicable. For showroom collection, the customer will be notified when the order has been accepted and when the products are ready for collection. The applicable sales contract shall be formed in accordance with the order acceptance process communicated to the customer and applicable Saudi laws and regulations.
  • Final Order Details Before submitting an order, customers will be provided with the relevant purchase details, including the selected products, total price, applicable fees, delivery or collection arrangements, and other material terms. Customers should carefully review these details before confirming their purchase.
  • Purchase Records Customers are encouraged to retain their order confirmation, invoices, and related correspondence for their records. To obtain information about a previous purchase, customers may contact Al Almas Alfaridah through its designated customer service channels.
  • Product Listings and Order Acceptance Product descriptions, images, prices, and other information displayed on the website are provided to help customers make informed purchasing decisions. Submission of an order constitutes a purchase request, which remains subject to acceptance by Al Almas Alfaridah. The company will communicate its acceptance or any issue preventing fulfilment in accordance with the applicable terms and Saudi laws and regulations.

Personal Information, Payment and Product Availability

1. Personal Information and Identity Verification

  • Al Almas Alfaridah may verify a customer's identity and order details where reasonably necessary to prevent fraud, protect customers, comply with applicable legal obligations, or process an order securely. Customers are responsible for providing accurate and up-to-date information. Where verification cannot be completed or material discrepancies are identified, the order may be placed on hold or declined, subject to applicable laws and regulations.
  • Where necessary and legally permitted, Al Almas Alfaridah may share relevant personal information with authorised identity verification providers, payment service providers, fraud prevention services, or competent authorities for legitimate purposes.
  • Customers may contact Al Almas Alfaridah through its designated privacy or customer service channels to enquire about the processing of their personal data, the relevant recipients, and their rights under the Saudi Personal Data Protection Law (PDPL) and its implementing regulations.
  • Customers may also request access to their personal data and exercise other applicable data subject rights in accordance with applicable law. Requests will be handled within the legally prescribed timeframes. Any fees, restrictions, or exceptions shall be applied only where permitted by applicable law.

2. Product Availability and Replacement Delivery

  • All orders are subject to product availability. If Al Almas Alfaridah is unable to fulfil an accepted order, the customer will be notified as soon as reasonably practicable and informed of the available options.
  • Where appropriate, Al Almas Alfaridah may offer an alternative product of equivalent value and comparable characteristics, subject to the customer's prior agreement. If the customer declines the proposed alternative, or an acceptable replacement cannot be provided, any refund due for the unavailable product will be processed in accordance with applicable Saudi laws and regulations.

3. Pricing Errors and Price Adjustments

  • The applicable price of a product will be displayed before the customer confirms the order, together with any applicable taxes, delivery charges, and other fees.
  • Al Almas Alfaridah takes reasonable steps to ensure that prices displayed on its website are accurate. However, an unintended pricing or calculation error may occasionally occur.
  • If an error is identified before the order is accepted, Al Almas Alfaridah may notify the customer of the correct price and request confirmation before proceeding. If the customer does not agree to the revised price, the order will not proceed and any amount paid for that order will be refunded where applicable.
  • If a pricing error is identified after the order has been accepted, Al Almas Alfaridah will handle the matter in accordance with the applicable contractual terms and Saudi laws and regulations. No additional amount will be charged without the customer's required consent.
  • Any revised price or alternative offer communicated to the customer will specify the period during which it remains valid. Customers will be given the opportunity to review and accept the revised terms before proceeding with the purchase.

Delivery

1. Delivery Costs and Estimated Delivery Times

Delivery charges and estimated delivery times will be communicated to the customer before the order is confirmed. Al Almas Alfaridah will use reasonable efforts to deliver products within the estimated timeframe provided. Delivery times may vary due to unforeseen circumstances, product availability, customisation requirements, or other factors beyond the company's reasonable control.

If a delay occurs, the customer will be notified as soon as reasonably practicable and provided with relevant information regarding the revised delivery estimate. Nothing in these Terms and Conditions excludes or limits any liability or consumer rights that cannot lawfully be excluded or limited under applicable Saudi laws and regulations.

For showroom collection, the customer must collect the order in person and present valid identification, unless an alternative arrangement has been approved in advance by Al Almas Alfaridah. If another person is authorised to collect the order, that person must provide written authorisation from the customer, together with valid identification for verification.

2. Risk of Loss or Damage

Al Almas Alfaridah remains responsible for the products until they are delivered to the customer or collected by the customer or an authorised representative, as applicable, in accordance with applicable Saudi laws and regulations.

3. Delivery Service Providers

Al Almas Alfaridah may use reputable courier companies or specialised secure-delivery providers, depending on the delivery destination, product value, and security requirements. The selected delivery provider and any applicable delivery arrangements will be communicated to the customer where appropriate.

For high-value diamonds, gemstones, and jewellery, additional security measures or specialised delivery services may be arranged where necessary.

4. Delivery Address

The customer must provide a complete and accurate delivery address when placing an order. Unless another arrangement is confirmed in writing, delivery will be made to the address provided during checkout.

Customers who wish to change their delivery address must contact Al Almas Alfaridah as soon as possible. Address changes may not be possible once an order has been dispatched or where the courier's procedures prevent such changes.

Delivery may require a signature or other reasonable verification of the recipient's identity. Products will be considered delivered when they have been handed over to the customer or an authorised recipient at the agreed delivery address, subject to applicable law.

Where the customer chooses showroom collection, the order will be considered collected once it has been handed over to the customer or their authorised representative.

5. Dispatch Notifications and Missing Deliveries

Customers will receive a notification when their orders have been dispatched, together with any available tracking information.

If an order does not arrive within the estimated delivery timeframe, the customer should notify Al Almas Alfaridah through its designated customer service channels as soon as reasonably practicable. The company will coordinate with the relevant delivery provider to investigate the matter and provide an update.

Any reporting timeframe communicated to the customer is intended to facilitate investigation and must not be interpreted as removing any mandatory rights available under applicable Saudi laws and regulations.

6. Failed Delivery and Collection

If delivery cannot be completed because the customer is unavailable, the address is incorrect, or another delivery issue arises, the customer may be contacted to arrange redelivery or collection, where available.

Any additional delivery or return charges arising from a failed delivery will be communicated to the customer and applied only where permitted by applicable law and the agreed terms.

If the order remains undelivered, Al Almas Alfaridah will contact the customer to determine the appropriate next steps. Any cancellation, refund, or deduction of costs will be handled in accordance with the applicable Return and Refund Policy and Saudi laws and regulations. Custom-made or personalised products will be treated in accordance with the applicable legal requirements and any valid terms agreed with the customer.

7. Secure Delivery

Given the value of diamonds, gemstones, and jewellery, customers are encouraged to provide a secure delivery address where the order can be received by the customer or an authorised recipient. Additional identity verification, signature confirmation, or secure-delivery arrangements may be required for certain orders.

8. Priority and Express Delivery

Priority or express delivery may be available for selected products and destinations, subject to product availability, manufacturing requirements, and courier arrangements. Additional charges may apply and will be disclosed to the customer before the order is confirmed. Estimated delivery dates for customised or bespoke products may depend on the complexity of the design and the time required for production.

Right to Cancel and Return Products

1. Consumer Cancellation Rights

For eligible online purchases, customers may cancel their order within seven (7) days following payment receipt of the product, provided that the product has not been used or otherwise benefited from, in accordance with the Saudi E-Commerce Law and its implementing regulations.

This cancellation right does not apply to products manufactured or customised according to the customer's specific requirements, except where the product is defective or does not conform to the agreed specifications.

Nothing in this policy limits any rights or remedies available to customers under applicable Saudi laws and regulations.

2. Products Made to Order and Personalised Products

The statutory cancellation right described above does not apply to products manufactured at the customer's request or according to specifications selected by the customer, subject to applicable law.

Such products may include bespoke jewellery, rings designed to the customer's specifications, jewellery incorporating a gemstone into a setting selected for the customer, and items engraved or personalised according to the customer's instructions.

This exclusion does not affect the customer's rights where a product is defective or fails to conform to the agreed specifications.

3. Purchases Made in Showrooms

For products purchased directly at an Al Almas Alfaridah showroom, returns and exchanges will be handled in accordance with the applicable sales terms and Saudi laws and regulations. Any voluntary return or exchange arrangement offered by Al Almas Alfaridah will be communicated to the customer at the time of purchase.

Nothing in this section restricts any mandatory rights available to customers under applicable law.

4. How to Request a Cancellation or Return

To request a cancellation or return, customers should contact Al Almas Alfaridah through its designated customer service channels and provide their order number, purchase details, and reason for the request, where applicable.

Customers should submit their requests within the applicable statutory or contractual period. Al Almas Alfaridah will inform the customer of the relevant procedure, return arrangements, and any applicable requirements.

5. Refunds and Return Conditions

Where a cancellation or return is accepted, any refund due will be processed in accordance with applicable Saudi laws and regulations and the relevant payment provider's procedures.

Customers may be responsible for reasonable return costs where permitted by applicable law. No deduction or fee will be applied where prohibited by law.

Products should be returned with their original accessories, certificates, packaging, and accompanying documentation, where available. These requirements do not restrict any mandatory rights relating to defective, counterfeit, or non-conforming products.

Any reduction in value, damage, or other issue affecting a return will be assessed in accordance with applicable law and the circumstances of the case.

6. Return and Cancellation Request Template

Customers may use the following template when contacting our customer service team:

  • Order number:

  • Date of receipt (if applicable):
  • Product description:

Please submit your request through Al Almas Alfaridah's designated customer service channels.

Warranty Claims

If any product supplied by Al Almas Alfaridah is defective, damaged upon delivery, or materially different from the product ordered, the customer may contact our customer service team to submit a warranty claim. Following an assessment of the product and subject to applicable laws and regulations in the Kingdom of Saudi Arabia, Al Almas Alfaridah may arrange for repair, replacement, or a refund, as applicable.

This warranty is provided in addition to any rights and remedies available to customers under applicable Saudi laws and regulations. Nothing in this policy is intended to exclude or limit any mandatory consumer rights.

To submit a warranty claim, customers should contact our customer service team and provide their order number, proof of purchase, a description of the issue, and photographs where appropriate.

Returning Products for Inspection

Where a product must be returned for inspection, customers should return it with its accompanying certificate, jewellery box, and any special packaging supplied with the product, where reasonably available. Customers should follow the return instructions provided by our customer service team to ensure that the item is safely transported.

Proof of purchase may be requested to help verify the transaction. If a certificate has been lost or damaged, customers should contact us to discuss whether a replacement certificate can be obtained and whether any applicable laboratory or administrative fees may apply. Any fee will be communicated in advance and will not limit the customer's mandatory rights under applicable law.

Return shipping and insurance arrangements will be communicated to the customer before the product is returned. Responsibility for reasonable return costs will be determined in accordance with applicable law and the circumstances of the claim.

If a returned product shows damage beyond ordinary use, Al Almas Alfaridah may assess whether the damage affects the validity of the warranty claim. Any claim for a reduction in value or related costs will be handled in accordance with applicable law. No deduction will be made where prohibited by law.

External Inspections

If a customer requests an inspection at a location outside Al Almas Alfaridah's premises, the customer must contact our customer service team to discuss availability, shipping, insurance, inspection arrangements, and any applicable costs.

Where a deposit is required to cover agreed shipping or insurance expenses, the amount and payment terms will be communicated to the customer in advance. The inspection location, inspection period, and arrangements following the inspection will also be confirmed in writing before the item is dispatched.

Any deposit, cancellation, refund, or return arrangement will be handled in accordance with the terms agreed with the customer and applicable Saudi laws and regulations.

2. Warranty Exclusions

Al Almas Alfaridah may offer a warranty against manufacturing defects for eligible jewellery products, subject to the terms communicated at the time of purchase. The applicable warranty period and coverage will depend on the product and the warranty expressly offered for it.

Unless otherwise required by applicable law, the warranty does not cover damage or deterioration resulting from:

  • Normal wear and tear arising from ordinary use.
  • Misuse, accidents, impact, negligence, or improper handling.
  • Failure to follow reasonable care and maintenance instructions.
  • Unauthorised alterations, modifications, repairs, or servicing by third parties.
  • Damage caused by external factors rather than a manufacturing defect.

Ordinary wear and tear does not, by itself, constitute a manufacturing defect. However, these exclusions do not apply where the issue is attributable to a manufacturing defect or where applicable law provides otherwise.

Customers are encouraged to have their jewellery inspected periodically by a qualified professional to help identify loose settings, worn components, or other issues that may require attention. Failure to obtain an inspection will not automatically invalidate a warranty claim; each claim will be assessed based on the condition of the product and the applicable warranty terms.

All warranty claims are subject to reasonable inspection and verification by Al Almas Alfaridah or an appropriate specialist. If a manufacturing defect is confirmed, the available remedy will be determined in accordance with the applicable warranty and Saudi law. Where legally permitted, the proposed remedy may include repair, replacement, or refund, as appropriate to the circumstances.

Any warranty applicable to jewellery made from particular metals, including 9-karat gold, will be specified in the product description or warranty documentation provided at the time of purchase. A shorter warranty period or different coverage will apply only where clearly communicated and legally permitted. Nothing in this section limits any mandatory rights or remedies available under applicable law.

3. Ring Resizing

Ring sizes and jewellery measurements are approximate and may vary according to the design and manufacturing process. Customers who are unsure of their ring size should contact our customer service team before placing an order for guidance on selecting an appropriate size.

Al Almas Alfaridah may offer complimentary resizing for eligible rings within sixty (60) days of delivery, subject to the product's design, material, condition, and the resizing terms confirmed at the time of purchase. This service is a voluntary benefit and does not affect any statutory rights relating to defective or non-conforming products.

Not all rings can be resized. Full-eternity rings, certain gemstone-set designs, and some bespoke or intricate pieces may require specialist assessment, remanufacture, or replacement. Any applicable limitations and additional charges will be explained to the customer before work begins.

Resizing Within 60 Days of Delivery

For eligible rings, complimentary resizing may be available within sixty (60) days of delivery. The extent of resizing available without charge depends on the design and the number of sizes by which the ring must be adjusted.

  • Plain engagement rings and wedding bands: Resizing may be available within the permitted size range. Larger adjustments may require an additional charge or remanufacture.
  • Diamond-set, gemstone-set, vintage, trilogy, halo, and other intricate rings: Each item must be assessed to determine whether resizing is possible and whether any additional work is required.
  • Half-eternity and three-quarter-eternity rings: These items require assessment because the setting may limit the extent of resizing.
  • Full-eternity rings: These generally cannot be resized due to the continuous setting. Alternative options may be discussed with the customer.
  • Bespoke and customised rings: Resizing is subject to the design and feasibility of the requested adjustment. Additional costs may apply where the work is complex or remanufacture is required.
  • Cocktail rings and collection pieces: Resizing availability depends on the individual design and must be confirmed following assessment.
  • Toi et Moi rings: Resizing is subject to the design, stone proportions, and feasibility of the requested adjustment. Any proposed stone change or replacement may incur additional costs, which will be communicated in advance.

Resizing After 60 Days

Resizing requested after the sixty-day period may be available for a fee, depending on the ring's design, material, condition, and the work required. Plain bands may be suitable for resizing, while engraved, diamond-set, gemstone-set, eternity, and bespoke rings may require additional assessment.

If a ring cannot be resized and must instead be remade, the customer will receive a quotation before the work proceeds. Any charge for additional metal, gemstones, labour, or remanufacture will be communicated and agreed in advance.

Only items that meet the applicable condition and eligibility requirements will be accepted for voluntary resizing or remanufacture. These conditions will not restrict remedies that a customer is entitled to receive for defective or non-conforming products under applicable law.

Processing Times and Charges

Resizing times depend on the design, workload, and availability of materials. An estimated processing period will be provided after assessment and excludes delivery time unless otherwise stated. Priority services may be available for an additional fee.

Customers should contact Al Almas Alfaridah's customer service team before sending a ring for resizing. No paid resizing or remanufacturing work will begin until the customer has been informed of and agreed to the applicable charges.

4. Professional Assessment and Revaluation

Customers may contact Al Almas Alfaridah to enquire about professional jewellery assessments, condition inspections, or revaluation services, subject to availability.

These services may be offered at a showroom or through an approved arrangement, depending on the nature of the item and the service requested. Fees, estimated completion times, and any applicable shipping or insurance costs will be communicated in advance.

If an assessment identifies a repair requirement, any proposed repair and its cost will be explained to the customer before the work proceeds. Repairs covered by an applicable warranty will be handled in accordance with the relevant warranty terms and applicable law.

A valuation or assessment reflects the scope and purpose of the service requested and should not be treated as a guarantee of a future resale price or market value.

5. Ownership and Collection of Products

Unless otherwise agreed in writing, ownership of a product will transfer to the customer in accordance with the applicable sales terms and Saudi law. Any outstanding payment obligations remain subject to the agreed payment terms.

If a product has been supplied before payment is completed under an agreed arrangement, Al Almas Alfaridah may request payment or return of the product where legally permitted and in accordance with the applicable agreement. Any return arrangements and associated costs will be communicated to the customer and handled in accordance with applicable law.

Where a customer has arranged to collect an item from a showroom, Al Almas Alfaridah will notify the customer when the item is ready. Customers should collect the item within the period communicated by our team.

If an item remains uncollected after repeated reasonable notifications, Al Almas Alfaridah will contact the customer to agree on the next steps. Any storage fees, costs, or other charges will apply only where lawfully permitted and clearly communicated in advance. The company's responsibility for an uncollected item will be determined in accordance with applicable law.

6. Jewellery Care

Al Almas Alfaridah encourages customers to care for their jewellery appropriately to help preserve its appearance and condition.

Customers may contact our customer service team to enquire about available cleaning, polishing, inspection, or maintenance services. The availability of these services, whether complimentary or chargeable, will be confirmed at the time of enquiry.

Professional cleaning, polishing, and repair services may be subject to an assessment of the jewellery's design, materials, gemstones, and condition. Any applicable fee or risk associated with the requested service will be communicated before the work begins.

Customers should follow the care instructions supplied with their jewellery and seek professional advice before using cleaning products or methods that may damage certain metals, gemstones, or settings.

Jewellery care services are separate from warranty coverage. Where a product has a qualifying manufacturing defect, the customer's rights under the applicable warranty and Saudi law remain unaffected.

Our Liability

  • General Liability. Al Almas Alfaridah shall be liable for damages in accordance with applicable laws and regulations in the Kingdom of Saudi Arabia. Nothing in these Terms shall exclude or limit liability where such exclusion or limitation is prohibited by applicable law.
  • Contractual Obligations. Al Almas Alfaridah shall be responsible for losses arising from a breach of its contractual obligations, subject to applicable law. Any limitation of liability shall apply only to the extent legally permitted and shall not exclude liability for intentional misconduct, gross negligence, or other circumstances in which liability cannot lawfully be limited.
  • Representatives and Service Providers. To the extent permitted by applicable law, any limitation of liability under these Terms shall also apply to the relevant representatives, employees, or authorised service providers of Al Almas Alfaridah. Nothing in this clause shall restrict any rights or remedies available to customers under applicable law.
  • Defects and Warranties. Nothing in these Terms shall exclude or limit Al Almas Alfaridah's liability for defects that it has knowingly concealed, warranties expressly provided to the customer, or any other liability that cannot lawfully be excluded or limited. Customers' rights and remedies in relation to defective, damaged, or non-conforming products shall remain subject to applicable Saudi laws and regulations.

Import Duties and Taxes

  • Delivery Within Saudi Arabia. Any customs duties, taxes, or other charges applicable to orders delivered within the Kingdom of Saudi Arabia will be handled in accordance with applicable Saudi laws and regulations. Any additional charges payable by the customer will be communicated before the order is completed, where applicable.
  • International Deliveries. If an order is delivered outside the Kingdom of Saudi Arabia, it may be subject to import duties, customs charges, taxes, or other fees imposed by the destination country. Unless otherwise expressly stated at the time of purchase, the customer is responsible for any such charges payable by the recipient under the applicable laws of the destination country. Al Almas Alfaridah does not control these charges and cannot guarantee their amount.
  • Customs Information. Customers are responsible for complying with the applicable import and customs requirements of the destination country. Customers are encouraged to contact the relevant customs authority before placing an international order to confirm any applicable restrictions, documentation requirements, duties, and taxes.
  • Compliance with Applicable Laws. Al Almas Alfaridah and its customers must comply with applicable laws and regulations governing the sale, export, import, and delivery of jewellery and gemstones. Nothing in this section excludes or limits any liability or customer rights that cannot lawfully be excluded or limited.

Force Majeure

  • Events Beyond Our Control. Al Almas Alfaridah shall not be held liable for any failure or delay in performing its contractual obligations to the extent that such failure or delay results from events beyond its reasonable control, including natural disasters, extreme weather conditions, epidemics, pandemics, war, terrorism, civil unrest, government actions, changes in applicable laws or regulations, interruptions to transportation or logistics, or failures of essential utilities or communication networks.
  • Suspension and Mitigation. To the extent permitted by applicable law, the affected obligations of the relevant party shall be suspended for the duration of the force majeure event. The affected party shall take reasonable steps to mitigate the effects of the event and resume performance as soon as reasonably practicable.
  • Prolonged Force Majeure. If a force majeure event continues for more than two (2) months and materially prevents performance of the affected sales contract, either party may terminate the affected contract by providing written notice to the other party, subject to applicable law. Any payments, refunds, or other outstanding obligations arising from such termination shall be handled in accordance with the contract and applicable laws and regulations in the Kingdom of Saudi Arabia.
  • Customer Rights. Nothing in this clause shall exclude or restrict any rights or remedies available to customers under applicable Saudi laws and regulations.

4. No Transfer of Intellectual Property Rights

Nothing on the website or in these Terms grants customers a licence or other right to use any intellectual property owned by or licensed to Al Almas Alfaridah, except for the limited personal use expressly permitted under these Terms or otherwise authorised in writing.

5. Custom-Made Jewellery and Designs

Unless otherwise agreed in writing, intellectual property rights in pre-existing designs, design concepts, sketches, drawings, photographs, manufacturing methods, and other materials owned or licensed by Al Almas Alfaridah shall remain with their respective rights holders.

The purchase of custom-made or personalised jewellery does not, by itself, transfer ownership of intellectual property rights in the underlying design or related materials to the customer. Any rights granted to the customer in relation to a bespoke design shall be set out in the applicable written agreement.

Al Almas Alfaridah shall not use a customer's personal information or identifiable custom design for promotional or commercial purposes where such use requires the customer's consent, unless that consent has been obtained or another lawful basis applies. Any use of photographs or images of custom-made jewellery for marketing purposes shall be subject to applicable law and any relevant agreement with the customer.

Nothing in this section limits any intellectual property rights that belong to the customer or any third party under applicable law.
